This Return, Refund & Exchange Policy (“Policy”) applies to all purchases made from Niyaz, a brand owned and operated by Niyaz Fashion & Interior Industries Private Limited, having its registered address at Stirring Minds, Asaf Ali Road, 2-A/3, Delhi – 110002, India (“Company”, “we”, “us”, or “our”).

This Policy is framed in accordance with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.

By placing an order on our website, you agree to be bound by this Policy.

1. Nature of Products & General Disclaimer

Niyaz offers luxury décor items, handcrafted home objects, fragrances, and essential oils. Many of our products:

• Are handcrafted or made using natural materials

• May show minor variations in color, texture, finish, or fragrance intensity

Such variations are inherent characteristics of the products and do not constitute defects.

2. Return Eligibility (Strictly Limited)

Returns or exchanges are accepted only in the following circumstances:

• The product is damaged at the time of delivery

• The product is manufacturing-defective

• An incorrect product has been delivered

Returns are not accepted for:

• Change of mind

• Personal preference

• Dissatisfaction with fragrance strength or scent profile

• Décor not matching interiors or expectations

3. Non-Returnable & Non-Refundable Items

For hygiene, safety, and quality reasons, the following items are strictly non-returnable and non-refundable, except where required by law:

• Fragrances, essential oils, and scented products once opened, used, or tampered with

• Products without original packaging, tags, seals, or accessories

• Items damaged due to improper handling, misuse, negligence, or accidents

• Products purchased during sales, discounts, or promotional offers, unless received damaged or defective

4. Mandatory Intimation Timeline (Critical)

Any issue related to damage, defect, or incorrect delivery must be reported within 48 hours of delivery.

To raise a request, email care@niyaz.co with:

• Order number

• Clear photographs and/or video evidence

• Brief description of the issue

Requests raised after 48 hours shall be deemed invalid and may be lawfully rejected.

5. Verification & Approval

• All return requests are subject to internal verification and quality checks.

• Approval or rejection will be communicated after reviewing the evidence provided.

• Submission of proof does not automatically guarantee approval.

6. Reverse Pickup & Condition of Return

• Approved returns will be picked up via our logistics partners (where serviceable).

• Products must be returned:

  • Unused

  • In original condition

  • With original packaging, labels, and accessories

If the returned product fails inspection, the return request shall stand cancelled and no refund or replacement shall be issued.

7. Refunds

• Refunds are processed only after successful inspection of the returned item.

• Refunds are issued to the original mode of payment.

• Processing time: 7–10 business days, subject to banking timelines.

Shipping, handling, and convenience charges are non-refundable, unless the return is due to our error.

8. Exchanges

• Exchanges are permitted only for approved cases of damage, defect, or incorrect item.

• Exchanges are subject to product availability.

• If a replacement is unavailable, a refund will be processed instead.

9. Cancellation Policy

• Orders may be cancelled only before dispatch.

• Once dispatched, orders cannot be cancelled or redirected.

Cancellation requests must be sent immediately to care@niyaz.co.

10. Transit Damage Disclaimer

While we ensure secure packaging, damages caused during transit must be:

• Refused at delivery or

• Reported within 48 hours with proof

Failure to comply may result in rejection of claims.

11. Limitation of Liability

To the maximum extent permitted under Indian law:

• Our liability shall be limited to the value of the product purchased

• We shall not be liable for indirect, incidental, or consequential damages

Nothing in this Policy limits rights that cannot be excluded under applicable law.

12. Governing Law & Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of India.
All disputes shall be subject to the exclusive jurisdiction of courts in Delhi, India.
